Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the NextDash website at nextdash.io, client portal, documentation, and the NextDash WooCommerce plugin and related software (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, you may not use the Services.

You must be at least 18 years old and capable of forming a binding contract to use the Services. You are responsible for ensuring that your use complies with all applicable laws and regulations in your jurisdiction.

To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@nextdash.io if you suspect unauthorized access.

When you purchase a NextDash plan, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the plugin on the number of websites allowed by your plan, subject to these Terms.

You may not, and may not permit others to:

• Redistribute, resell, sublicense, or share license keys except as expressly permitted by your plan
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law
• Remove or alter proprietary notices in the software
• Use the Services to build a competing product or service
• Use the Services in violation of applicable law or third-party rights
• Circumvent license validation, activation limits, or security measures

The free version of NextDash, where available, is licensed for use under the terms applicable to that distribution. Premium features require a valid paid license.

Paid plans are billed on a monthly or annual basis as selected at checkout. Prices are displayed on our website and may change for new purchases; we will provide notice of material price changes where required.

Payments are processed by Lemon Squeezy. By purchasing, you also agree to Lemon Squeezy's applicable terms. Subscriptions renew automatically unless canceled before the renewal date through your billing portal or by contacting support.

Annual plans include one year of updates and support from the purchase date. After expiration, your existing installation may continue to function, but updates and support may require renewal.

Refunds are handled according to our Refund Policy. Please review that policy before making a purchase.

NextDash, including its software, branding, website content, documentation, and design, is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you any ownership rights—only the limited license described above.

Feedback you provide may be used by us without restriction or compensation to improve the Services.

The Services may integrate with or depend on third-party platforms such as WordPress, WooCommerce, payment processors, and authentication providers. We are not responsible for third-party services, and your use of them is subject to their respective terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY THEME, PLUGIN, OR HOSTING ENVIRONMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTDASH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless NextDash from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your access to the Services if you breach these Terms, misuse license activations, or engage in fraudulent activity. You may stop using the Services at any time. Upon termination, your license to use the plugin ends unless otherwise required by applicable law, though provisions that by their nature should survive will remain in effect.

We may modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Material changes may be communicated by email or website notice. Continued use after changes take effect constitutes acceptance.

These Terms are governed by applicable laws without regard to conflict of law principles. Any disputes shall be resolved in the courts or forums specified by mandatory consumer protection laws in your jurisdiction, where applicable.
